DATA PROTECTION ACT 1998 - FAIR PROCESSING NOTICE

Subject

This notice details the processing of personal data associated with the National Headship Development Programme (NHDP).

Purposes for processing personal data

The data that is held on the National Headship Development Programme (NHDP) participants comprises personal data obtained from the application forms of those individuals who participate in the National Professional Qualification for Headship (NPQH) and the Leadership Programme for Serving Headteachers (LPSH). Although there is no formal application process for the Professional Headship Induction Programme (PHIP), personal data is forwarded to the Welsh Assembly Government by the LEA to register headteachers on the programme when they gain their first headship appointment.

NPQH and LPSH data is processed by external service providers on behalf of the Welsh Assembly Government. For the NPQH programme, this function is undertaken by the Wales NPQH Centre while for the LPSH programme, this function is undertaken by Serco Learning. PHIP data is processed centrally by the Welsh Assembly Government.

NHDP data is processed by the Wales NPQH Centre, Serco Learning and the Welsh Assembly Government for the following purposes:

NPQH

• To maintain a register of candidates currently undertaking the programme.

• To confirm that candidates are registered with the General Teaching Council for Wales (GTCW) prior to awarding the NPQH qualification.

• To register details of successful NPQH candidates on the GTCW database.

• To provide details of successful candidates to individual LEAs.

• To obtain statistical data regarding the phase/preferred language/gender/ethnicity of candidates currently accessing the programme to inform future policies linked with school leadership.

• To obtain statistical data regarding the phase/preferred language of candidates currently

accessing the programme for inclusion in promotional literature to raise the profile of the

programme in Wales.

• To provide information to GTCW regarding NPQH candidates in receipt of professional

development funding. Whilst undertaking the NPQH programme candidates will not be eligible to access CPD funding accessible via GTCW.

• To inform Estyn research on the impact of the mandatory NPQH after September 2005.

PHIP

• To maintain a register of candidates currently undertaking the programme and monitor

expenditure during the programme.

• To ascertain whether candidates progress to the PHIP programme after successfully completing

the NPQH qualification.

• To circulate information to LEAs on a ternly basis to ensure that all new headteachers are

included on the database.

• To obtain statistical data regarding the phase/preferred language/gender of candidates currently

accessing the programme to inform furture policies linked with school leadership.

• To obtain statistical data regarding the phase/preferred language of candidates currently

accessing the programme for inclusion in promotional literature to raise the profile of the

programme in Wales.

• To provide information to GTCW regarding PHIP candidates in receipt of professional

development funding. Whilst undertaking the PHIP programme candidates will not be

• To maintain a register of candidates currently undertaking the programme and monitor

• To ascertain whether and when candidates access the LPSH programme after completing the

PHIP programme.

• To obtain statistical data regarding the phase/preferred language/gender/ethnicity of candidates

currently accessing the programme to inform future policies linked with school leadership.

• To obtain statistical data regarding the phase/preferred language of candidates currently

accessing the programme for inclusion in promotional literature to raise the profile of the

programme in Wales.

• To provide information to GTCW regarding LPSH candidates in receipt of professional

development funding. Whilst undertaking the LPSH programme candidates will not be

eligible to access CPD funding accessible via GTCW.

Security and access to recorded personal data

Access to the recorded personal data, as described above, is restricted to the Wales NPQH

Centre, Serco Learning, local education authorities, Estyn and designated staff within the Welsh

Assembly Government's School Leadership Branch. Prior to awarding the NPQH, appropriate

data will be forwarded to the General Teaching Council for Wales (GTCW) to ascertain whether

candidates are registered with the GTCW. Details of successful NPQH candidates will also be

entered onto the GTCW database.

Candidates' rights under the Data Protection Act 1998

Whilst the list below is not exhaustive, candidates have the following rights:

• Each candidate has the right to ask the Wales NPQH Centre, Serco Learning and/or the

Welsh Assembly Government to provide access to and a copy of personal data held about

them.

• Each candidate has the right, in specified circumstances, to ask the Wales NPQH Centre,

Serco Learning and/or the Welsh Assembly Government to stop processing personal data

about them

• Each candidate has the right to seek compensation if they believe they have suffered damage

or damage andf distress because the Welsh Assembly Government has processed personal data

about them in contravention of any of the requirements of the Data Protection Act 1998.

• Each candidate has the right to ask the Information Commissioner to carry out an assessment

of the way in which the Welsh Assembly Government has processed personal data about

them.
